1. Who we are

This website is operated by Bena Pets, a sole proprietorship owned by Rony Benavides, registered at Vela y Klever Franco, 070150, Machala, El Oro, Ecuador. Throughout the site the terms “we”, “us” and “our” refer to Bena Pets.

By visiting benapets.com or placing an order you agree to these Terms of Service, together with our Shipping Policy, Return and Refund Policy and Privacy Policy, which are incorporated here by reference. If you do not agree, do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use is lawfully yours.

3. Products, descriptions and pricing

We make every reasonable effort to display our products and their colours accurately, but we cannot guarantee that your screen reproduces colour exactly. Product dimensions and weights are approximate and are supplied by the manufacturer.

All prices are shown in U.S. dollars (USD) and include the cost of standard shipping. We reserve the right to change prices, modify or discontinue any product at any time without notice.

Should a product be listed at an incorrect price because of a typographical or system error, we reserve the right to refuse or cancel the order, even if it has already been confirmed and charged. In that event we refund you in full, promptly and without deduction.

4. Product suitability and animal safety

Our products are accessories for animals. You are responsible for choosing items appropriate to your pet’s size, breed, age, temperament and health, and for supervising their use. Toys, chews, collars, harnesses and similar items can present a choking, entanglement or ingestion hazard if used unsupervised, if the wrong size is chosen, or if used after they become worn or damaged. Inspect items regularly and discontinue use if damaged.

Nothing on this site is veterinary advice. If your pet has a medical condition, allergy, or a behavioural issue, consult a licensed veterinarian before buying or using any product.

5. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a confirmation email. We reserve the right to limit quantities per person, per household or per order, and to refuse or cancel any order, including orders that appear to be placed by dealers, resellers or distributors, or that we reasonably suspect to be fraudulent.

If we cancel an order in whole or in part, we will notify you at the email address you provided and refund any amount charged.

6. Fulfillment by third parties

Orders are fulfilled and dispatched by our logistics partner, CJ Dropshipping, from its warehouses. We remain the merchant of record and remain fully responsible to you for the order, its delivery and any remedy owed to you. You deal with us, not with our supplier.

7. Payment

Payments are processed by third-party payment providers. We do not store your full card details on our systems. You warrant that the information you supply at checkout is complete and accurate. Where a charge is declined or reversed, we may cancel the order.

8. Shipping, returns and refunds

Delivery times, delay rights and cancellation rights are set out in our Shipping Policy. Return conditions, timeframes and refund processing are set out in our Return and Refund Policy. Both form part of these Terms.

9. Accuracy of your information

You are responsible for providing a correct and complete delivery address and a working email address. We are not liable for a failed delivery caused by an address you entered incorrectly, though we will always try to help you resolve it.

10. Intellectual property

All content on this site, including text, graphics, logos, product photography, and the compilation thereof, is the property of Bena Pets or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute or exploit it commercially without our prior written permission.

11. Prohibited uses

You may not use this site or its content for any unlawful purpose, to solicit others to perform unlawful acts, to infringe our or anyone else’s intellectual property, to harass or discriminate, to submit false information, to upload malicious code, to scrape or harvest data, or to interfere with the security features of the site.

12. Disclaimer of warranties

Except where a warranty is required by applicable law and cannot lawfully be excluded, the site and the products are provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted, timely, secure or error-free.

This clause does not limit any statutory right you have as a consumer, including under state consumer protection statutes or the Magnuson-Moss Warranty Act.

13. Limitation of liability

To the maximum extent permitted by applicable law, our total liability arising out of or relating to an order shall not exceed the amount you paid for that order. We are not liable for indirect, incidental or consequential losses.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the greatest extent permitted by law, and nothing here excludes liability for death or personal injury caused by our negligence, or for fraud.

14. Indemnification

You agree to indemnify and hold harmless Bena Pets and its suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. Changes to these Terms

We may update these Terms at any time. The version in force is the one published on this page, and the date at the top tells you when it last changed. Continued use of the site after a change constitutes acceptance of it. The Terms that apply to your order are those in force at the moment you placed it.

16. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision is severed and the remaining provisions continue in full force.

17. Governing law

These Terms are governed by the laws of the Republic of Ecuador, where our business is established. This does not deprive you of the protection of the mandatory consumer-protection rules of the U.S. state in which you habitually reside, and you may always bring proceedings in the courts of your own jurisdiction where local law gives you that right.
